¶1Heard Sri Santosh Kumar Yadav, learned counsel for the petitioner and Sri Tushar Verma, learned Addl. C.S.C. for the State.

¶2The grievance of the petitioner is that the opposite parties are constructing a water tank on Gata No. 431 situated at Village-Mohanpur, Pargana & Tehsil-Tulsipur, District-Balrampur which is recorded as Khalihan in the revenue records, however, learned Standing Counsel for the State disputes this fact and says that tank is being constructed on land which is recorded as Naveen Parti and not a Khalihan.

¶3Considering the disputed question of facts, we do not find any reason to proceed with these proceedings any further. If the petitioner has any grievance he can approach the Collector for redressal of his grievance.
