¶1Heard learned counsel for the petitioner and Ms. Priyanka Rai, Advocate holding brief of Sri Shishir Jain, learned counsel appearing on behalf of the respondents no. 1 to 3.

¶2With the consent of learned counsel appearing on behalf of the contesting parties, the instant writ petition is being finally decided.

¶3Instant writ petition has been filed praying for a mandamus commanding the respondents to open the sealed cover for promotion to the post of Assistant Engineer (Civil).

¶4The contention is that the claim of the petitioner had been considered by the respondents for the post of Assistant Engineer (Civil) by the Departmental Promotion Committee and kept in sealed cover on 18.11.2021. Subsequent thereto, the petitioner has been exonerated in the inquiry which was conducted against him yet the sealed cover has still not been opened and hence the petition.

¶5On the other hand, Ms. Priyanka Rai, learned counsel for the respondents states that a final decision would be taken within a period of two weeks from today pertaining to opening of the sealed cover of the post of Assistant Engineer (Civil) of the petitioner.
