Judgment

Court No. - 18 Case :- MATTERS UNDER ARTICLE 227 No. - 5035 of 2023 Petitioner :- Rajmuni Respondent :- State Of U.P. Thru. Prin. Secy., Revenue Deptt., Lucknow And Others Counsel for Petitioner :- Raj Priya Srivastava Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Saurabh Lavania,J. Heard. In view of order proposed to be passed, issuance of notice to the private-respondent(s) is hereby dispensed with. By means of the present petition, petitioner seeks expeditious disposal of Revision No.120 (Ram Achaibar & Others vs. Rajmuni & Others) under Section 48(1) of the U.P. Consolidation of Holdings Act, which is pending before the respondent No.3. Taking note of the fact that the revision, in issue, is pending since 2012 and the matter is at the stage of arguments, as indicated in the present petition and also that the petitioner is a senior citizen aged about 71 years, this Court is of the view that no fruitful purpose will be served in keeping this petition pending. Learned State counsel submits that he has no objection in case an expedite order is passed. Accordingly, present petition is disposed of with direction to respondent No.3-Deputy Director of Consolidation, Ambedkar Nagar to consider and decide the Revision No.120 (Ram Achaibar & Others vs. Rajmuni & Others), most expeditiously, after affording full opportunity of hearing to the parties, but without granting any unnecessary adjournment to either of the parties preferably within a period of four months from the next date fixed in the case. It is made clear that this Court has not examined the case of either party on merits and the Authority concerned shall be free to decide the matter strictly in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 10.10.2023/Vinay/- High Court of Judicature at Allahabad, Lucknow Bench
