Judgment

Court No. - 10 Case :- CRIMINAL MISC. WRIT PETITION No. - 7784 of 2023 Petitioner :- Shalini Verma Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. U.P. Govt. Lucknow And Others Counsel for Petitioner :- Birendra Kumar Yadav,Satendra Jaiswal Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Narendra Kumar Johari,J. Heard learned counsel for the petitioner, learned AGA who appears on behalf of the State-respondents and perused the record. This writ petition has been filed with a prayer to issue a writ, order or direction in the nature of Certiorari for quashing of the First Information Report dated 10.9.2023 registered as FIR No. 450 of 2023 under Sections 420, 467, 468, 471, 406, 409 and 120B IPC, P.S. Pura Kalandar, District Ayodhya and for a direction to the respondents not to arrest the petitioner pursuant to the impugned FIR. It has been submitted by the learned counsel for the petitioner that the petitioner was the Village Development OfÏcer of Village Mainuddinpur, Pragna Paschim Rath, Tehsil Sohawal, Block Masauda, District Ayodhya. Some work was carried out of construction of four animal sheds for which payment was made to those who were engaged on muster roll. She went on maternity leave on 28.4.2022 and remained on such leave for six months. Thereafter she again went for child care leave from 19.11.2022 and returned to work only on 17.1.2023. She was transferred thereafter. A perusal of the FIR would show that she has not committed any offence of embezzlement and misappropriation as alleged. This Court has perused the FIR and finds from the same that there is a preliminary fact finding enquiry report and statements of witnesses recorded on a pen-drive which has been submitted to the police by the informant who has lodged the FIR in his ofÏcial capacity as Block Development OfÏcer, Masauda, Ayodhya, therefore, this Court finds no good ground to show interference in the impugned FIR. In view of the aforesaid, writ petition is dismissed. Order Date :- 10.10.2023 AKK High Court of Judicature at Allahabad, Lucknow Bench
