Judgment
Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 915 of 2023 Petitioner :- Ishwar Kumar Respondent :- State Of U.P. Thru. Prin.Secy.Deptt. Of Panchayat Raj Civil Secrt. Lko. And Ors. Counsel for Petitioner :- Shubham Yadav Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Attau Rahman Masoodi,J. Hon'ble Om Prakash Shukla,J.
¶1Heard learned counsel for petitioner, Shri Dilip Kumar Pandey, learned counsel for respondent No.9 and learned Standing Counsel for State-respondent Nos.1 to 8.
¶2The petitioner has not disclosed his credentials in the writ petition filed in public interest. It is well settled in the case of State of Uttranchal vs. Balwant Singh Chaufal & Ors., 2010 AIR SCW 1029 that the petitioner in a P.I.L. is duty bound to explain his locus in background of being a public spirited person. There is no disclosure of any social work whatsoever in the present writ petition which may enable us to decipher the locus of the petitioner.
¶3Locus of a person, in all such cases, has to be well defined in the background of social services which in the present case remain undefined. The petitioner is unable to put forth any explanation in this regard.
¶4Once the credibility of the petitioner remains doubtful, any prayer for a roving enquiry against a public representative may not be maintainable.
¶5The P.I.L. fails on the strength of locus remaining undefined and the same is dismissed. (Om Prakash Shukla, J.) (Attau Rahman Masoodi, J.) Order Date :- 10.10.2023 Shubhankar High Court of Judicature at Allahabad, Lucknow Bench
