¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed seeking a direction to opposite parties to consider recommendation dated 27.02.2023 made by the committee concerned for providing age relaxation to petitioners for appointment on the post of regular Collection Peons from the current post of Seasonal Collection Peons.

¶3It has been submitted that petitioners were initially appointed as Seasonal Collection Peons from year 1988 onward and in pursuance of relevant Regulations, have been recommended for regular appointment on post of Collection Peons by means of recommendation dated 27.02.2023 in pursuance of select list dated 12.12.2022. It is submitted that since petitioners have become overage, age-relaxation can only be granted by the State Government in terms of Government Order dated

22.02.2019 . It is submitted that in similar circumstance, other persons who were also selected vide list dated 12.12.2022 have already been granted such age relaxation by the State Government and petitioners are also required to be accorded parity with them.

¶4Considering submissions advanced, opposite party no.1 i.e. Additional Chief Secretary/Principal Secretary Revenue Anubhag-7 U.P., Lucknow is directed to consider and decide the recommendation dated 27.02.2023 made by the Committee concerned in pursuance of select list dated 12.12.2022. Appropriate orders shall be passed in light of Government Order dated 22.02.2019 in case the same is applicable upon petitioners. Final decision with regard to same shall be taken by opposite party no.1 within a period of eight weeks from the date a certified copy of this order is produced before the said authority.
