Petitioner has approached this Court challenging a notice dated

16.08.2023 , whereby he has been asked to remove the unauthorized construction from the property in dispute. Learned counsel for the petitioner submits that the said notice does not even permit the petitioner to give a reply to the same. Mr. Ratnesh Chandra, learned counsel for the Lucknow Development Authority is not in a position to dispute the said fact. However, looking to the facts and circumstances of the case, petitioner is permitted to file a reply to the said show cause notice dated 16.08.2023 issued by the competent authority-respondent no. 4 within a period of two weeks from today alongwith the certified copy of this order. Any further action by the respondents shall be subject to final order to be passed by the respondent no.4 after taking into consideration the reply submitted by the petitioner. In case, reply to the show cause notice dated 16.08.2023 is not submitted by the petitioner within the aforesaid time, benefit of this order would not be available to him.
