¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed seeking a direction to opposite parties for payment of post-retiral benefits to petitioner in view of fact that petitioner has superannuated from service on 31.12.2022.

¶3It has been submitted that although no departmental proceedings are pending against petitioner but a criminal case pertaining to year 1993 that is prior to petitioner joining services on 17.01.1995, is still pending consideration. It is submitted that even therein, i.e. Complaint Case bearing no.108 of 2016, a final report has been submitted but objections to final report have been filed and are still pending consideration.

¶4For the said grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned. At present, learned counsel for petitioner restricts prayer with regard to final decision on the same.

¶5Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no.2 i.e. Director, Child Development and Nutrition, U.P., Lucknow who shall consider and decide the same in accordance with law and judgments on aforesaid point within a period of eight weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
