¶1Sri Shailendra Singh Chauhan, Advocate has filed power on behalf of respondents no.1 to 3 and the same is taken on record.

¶2Heard learned counsel for parties.

¶3Petitioner has approached this Court for a mandamus commanding respondents no.1 to 3 not to seal the shop of petitioner till the pendency of present writ petition.

¶4The dispute is that petitioner is a tenant of a shop of respondents no.4 to 6 and there are huge amount of house tax dues against respondents no.4 to 6 with regard to entire building which consist house of respondents and other shops including the shop of which petitioner is a tenant.

¶5Sri Shailendra Singh Chauhan, learned counsel for respondent Nagar Nigam submits that petitioner has made a representation on 03.10.2023 to the Nagar Nigam that he is ready and willing to pay the dues of house tax of the shop in his possession. He states that Nagar Nigam is in process of assessing the same. He further states that shop of petitioner is not going to be sealed in case he pays the dues of house tax which would be raised against petitioner with regard to shop under his possession.

¶6Both the aforesaid statement of learned counsel for respondent Nagar Nigam is taken on record.
