Case of the petitioners is that father of the petitioners, who was the Junior Assistant in the office of the Special Land Acquisition, had transferred some amount wrongly and the same was directed to be paid by him which he had already paid. Late on, the said amount which had wrongly transferred to the incorrect account was returned by the person to whom it was incorrectly sent. Thus, the petitioner claims that as the amount was already paid, the petitioner are entitled for return of the amount deposited by them. Learned Standing Counsel raises the preliminary objection that it was a service matter as the amount was directed to be paid by the father of the petitioner, hence the present writ petition relates to the recall of the said order and it is a service matter. Learned counsel for the petitioners prays to withdraw the present writ petition with liberty to file afresh before appropriate Bench by annexing all the relevant documents.
