Judgment

Court No. - 7 Case :- WRIT - C No. - 8777 of 2023 Petitioner :- C/M, Maharshi Balmiki Vidyalaya, Kanpur Nagar Thru. Its Manager Respondent :- State Of U.P. Thru. Addl. Chief/ Prin. Secy., Social Welfare Deptt., Lucknow And 3 Others Counsel for Petitioner :- Pawan Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Abdul Moin,J. Heard learned counsel for the petitioner, learned State counsel appearing for respondent nos.1 & 2 who has also accepted notice on behalf of respondent nos. 3 & 4. With the consent of learned counsel appearing for the contesting parties, the writ petition is finally being disposed of. The instant writ petition has been filed with a prayer of mandamus commanding the respondent no.1 to take a decision for grant of financial approval for payment of salary to 4 Assistant Teachers who have been appointed in the petitioner's Institution in pursuance of the letter dated 27.01.2020. The contention is that despite the teachers having been appointed and the respondent no.1 being required to take a decision pertaining to financial approval of the salary of the teachers as working in the petitioner Institution, no decision has been taken in the matter till date. Considering that the matter is pending at the end of respondent no.1, the instant writ petition is disposed of with a direction to the respondent no.1 to take a final decision for grant of financial approval for payment of salary to the 4 Assistant Teachers of the petitioner Institution in accordance with law and the relevant rules along with relevant government orders within a period of four weeks from the date of receipt of certified copy of this order. It is made clear that this Court has not gone into the merits of the claim set forth by the petitioner. Order Date :- 11.10.2023 S. Shivhare High Court of Judicature at Allahabad, Lucknow Bench
