Learned A.G.A. is present. Learned A.G.A. on the basis of instructions dated 07.10.2023 received from the concerned police station has submitted that detenue no. 1 on her own accord and free will is residing with respondent no. 4 along with her two children Aradhya Singh (detenue no. 2) and Kartik Singh (detenue no. 3). Instructions provided by the learned A.G.A. is taken on record. On due consideration to the submissions advanced by learned A.G.A. as well as perusal of the instructions, it appears that due to cruelty committed by the deponent, detenue no. 1 who is legally wedded wife of the deponent is residing with respondent no. 4 along with detenue no. 2 and 3 who are her minor children and prima facie it is clear that it is not a case of illegal detention.
