Judgment
Court No. - 7 Case :- WRIT - A No. - 1609 of 2023 Petitioner :- Brajesh Tripathi Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Technical Edu. Lko. And 5 Others Counsel for Petitioner :- Rajendra Kumar Counsel for Respondent :- C.S.C.,R.B.S. Rathaur Hon'ble Abdul Moin,J. Heard learned counsel for the petitioner and learned Standing Counsel for respondents no. 1 to 2 as well as Shri R.B.S. Rathaur, learned counsel appearing for respondent nos.2, 4 & 5. With the consent of learned counsel appearing for the contesting parties, the writ petition is finally being disposed of. The instant writ petition has been filed with a prayer
of mandamus
commanding the respondents to promote the petitioner in accordance with rules and regulations of AICTE with a further prayer commanding the respondents to restructure/revise the salary of the petitioner in accordance with the qualification possessed by the petitioner and the year of service of the petitioner and to fix the seniority of the petitioner accordingly. This Court had required Shri R.B.S., learned counsel appearing for respondent nos. 2, 4 & 5 to seek instructions. Shri Rathore informs that till date, he has been unable to seek instructions. As the matter is too trivial to be kept pending before this Court and the reliefs as have been prayed for are to be considered by the competent authority itself as such, the writ petition is disposed of by providing that it would be open to the petitioner to submit a fresh representation before respondent no.4 i.e. Director, Feroz Gandhi Institute of Engineering and Technology, Raebareli within a period of two weeks from today. In case any representation is made, the respondent no.4 shall proceed to consider the same in accordance with law and the relevant rules within a period of four weeks from the date of receipt of the said representation along with the certified copy of this order. It is made clear that this Court has not gone into the merits of the claim set forth by the petitioner. Order Date :- 11.10.2023/S. Shivhare High Court of Judicature at Allahabad, Lucknow Bench
