¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed seeking a direction to opposite parties for payment of gratuity and final pension along with arrears and interest with effect from 01.02.2014.

¶3It has been submitted that earlier petitioner was implicated in a criminal case which has resulted in his acquittal by means of judgment and order dated 31.01.2023. It is submitted that no appeal thereagainst has been filed but even thereafter aforesaid dues of petitioner are not being paid to him. It is further submitted that for the the said grievance, petitioner had submitted a representation to the authority concerned but the authorities are seeking clarification from one another instead of making payment of dues of petitioner. It is submitted that opposite party no.4 is the competent authority for sanctioning the amount.

¶4Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no.4 i.e. Commissioner of Police, Lucknow Commissionerate, Lucknow who shall consider and decide the same within a period of eight weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
