Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5184 of 2023 Petitioner :- Sheetala Prashad Respondent :- The Court Of Learned Civil Judge (Junior Division), Haveli, Faizabad And Another Counsel for Petitioner :- Maya Ram Yadav Hon'ble Rajnish Kumar,J. Heard Sri Maya Ram Yadav, learned counsel for the petitioner. This petition has been filed for direction for disposal of Original suit for partition bearing No.277 of 2021(Sheetla Prasad versus Keshav Ram) pending in the Court of Civil Judge(J.D.), Haveli Faizabad. Perusal of the typed copy of the order sheet annexed with the petition indicates that the written statement has come in the month of January 2023 when the petitioner himself had not appeared and thereafter only dates have been fixed. Therefore only on merely asking of the petitioner, no direction can be issued for disposal of the suit filed in the year 2021 in which prior to month of January also, the parties have not appeared on few dates. Learned counsel for the petitioner also failed to indicate any urgency in the matter. In view of above, this court is not inclined to issue any direction at this stage for disposal of suit within the time frame. Even otherwise, if there is any urgency in the matter, it is always open to the parties to move appropriate application for expeditious disposal before the concerned court showing urgency, who may consider and decide the same according to roster after affording opportunity to the parties and pass appropriate orders in accordance with law. With the aforesaid, the petition is dismissed. . Order Date :- 12.10.2023 Akanksha High Court of Judicature at Allahabad, Lucknow Bench
