Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5195 of 2023 Petitioner :- Smt. Chandrawati Respondent :- Smt. Tara Devi Counsel for Petitioner :- Rajesh Kumar Kashyap Hon'ble Rajnish Kumar,J. Heard Sri Rajesh Kumar Kashyap, learned counsel for the petitioner. This petition has been filed for direction for disposal of Original Suit No.739 of 2020(Smt. Chndrawati versus Smt. Tara Devi) pending in the Court of Civil Judge(Junior Division) South Unnao. Perusal of the order sheet indicates that the interim injunction application of the petitioner has been allowed by means of the order dated 01.04.2022 granting injunction of status quo till disposal of the suit. It is further reflected from the order sheet that some application for amendment has been moved on

01.04.2022 which has yet not been disposed of and the case is being fixed for disposal of application No.7Ga/14Ga/35Ga. On a query being put, learned counsel for the petitioner submits that he has moved an application for correction in the order passed on application 7Ga. In view of above, when the petitioner is pressing certain applications before the concerned court and amendment application is also pending, this Court does not deem it fit to issue any direction for expeditious disposal of the suit merely because the petitioner wants that the suit may be disposed of at an early date in view of large pendency of cases. Even otherwise, if the applications are not disposed of or there is any urgency in the matter, it is always open for the petitioner to move appropriate application before the concerned court showing urgency, which may be considered by the concerned court after affording opportunity to the parties and pass appropriate orders in accordance with law. With the aforesaid, the petition is dismissed. Order Date :- 12.10.2023 Akanksha High Court of Judicature at Allahabad, Lucknow Bench
