¶1Heard learned counsel for petitioner, Sri Ambrish Rai, learned counsel for respondent no.1 and Sri Sarvesh Kumar Dubey, learned counsel for NHAI.

¶2Petitioner has approached this Court challenging Office Letter dated 5.10.2023 whereby respondents have shown petitioner's technical bid to be non-responsive on certain grounds.

¶3Learned counsel for NHAI submits that the said Office Order only points out technical defects in technical bids and asked the petitioner to submit their response. He further submits that the financial bid will be opened on 23.10.2023.

¶4Learned counsel for petitioner submits that petitioner has already submitted their response to the said Office Order.

¶5In the given facts and circumstances, respondents are duty bound to look into the representation made by petitioner and other similarly situated persons whose technical bids are non-responsive before taking any final decision in the matter. Therefore, respondents shall, before finalizing the contract, take a decision on the representation made by petitioner in accordance with law and also provide a copy of the same to the petitioner.
