¶1Heard learned counsel for petitioner and learned State Counsel for opposite party nos.1 to 4. In view of the order being passed, notice to opposite party nos.5 to 7 stands dispensed with.

¶2Petition has been filed seeking following reliefs:- "I) Issue a writ, order or direction in the nature of mandamus commanding to the opposite parties particularly to the opposite party no. 2 and 5 to add name of the petitioner in Seniority List of Drivers at the proper place and provide all benefits of Seniority when it falls due.

(II). Issue a writ, order or direction in nature of mandamus commanding to the opposite parties particularly to the opposite party no. 2 to pay the arears of differenes of salary w.e.f. 13-9-2010 on the principle of "Equal Pay for Equal Work" upto its payment with 12% interest and further to pay equal salary to the opposite party nos. 6 and 7 month to month regularly.

(III). Issue a writ, order or direction in nature of mandamus commanding to the opposite parties to promote the petitioner w. e. f. the juniors have been promoted in Grade Pay 2400 to Grade Pay 2800/---.

(IV). Issue any other order or direction which this Hon'ble Court deem fit, just and legal under circumstance of the case to maintain equality before the law and justice."

¶3For the said relief, petitioner has already submitted a representation dated 11.09.2023.

¶4At present, learned counsel for petitioner restricts his prayer for a decision with regard to same.

¶5Considering the innocuous prayer, without entering into merits and particularly considering the fact that addressing petitioner's grievance would require consideration of factual aspects, opposite party no.2 i.e. Special Secretary Evam Rajya Sampatti Adhikari, Estate Department, Civil Secretariat, U.P. Lucknow is directed to consider and decide representation of petitioner dated 11.09.2023 within a period of eight weeks, from the date a certified copy of this order is produced before the said authority along with copy of the representation dated 11.09.2023.
