¶1Heard Syed Asaghar Mehdi, learned counsel for the applicant, Sri Nirmal Kumar Pandey, learned AGA for the State and perused the record.

¶2The instant application has been filed that this Hon'ble Court may graciously be pleased to directed to the Sub Divisional Magistrate Utraula District Balrampur, to decide the Criminal Case no. 04/04/04/05/06/08/24 "Haleema and others versus Madhav" Under Section 133 Cr.P.C Police Station Kotwali Utraula District Balrampur, pending before the Sub Divisional Magistrate Utraula District Balrampur since 07.08.2013, expeditiously within a period fixed by this Hon'ble Court in the interest of justice.

¶3Learned counsel for the applicant quoting the aforesaid prayer submits that the matter is still pending consideration and the applicant is suffering due to delay in conclusion of the Criminal Case no. 04/04/04/05/06/08/24. He submits that the interest of justice would be subserved if this Hon'ble Court is pleased enough to direct the Sub Divisional Magistrate Utraula District Balrampur, to decide the Criminal Case no. 04/04/04/05/06/08/24 within a stipulated period of time as may be fixed by this Court.

¶4The counsel appearing for the State has no objection to the contention aforesaid.

¶5Considering the submissions of the learned counsel for the parties, the Sub Divisional Magistrate Utraula District Balrampur, is hereby directed to conclude the Criminal Case no. 04/04/04/05/06/08/24 "Haleema and others versus Madhav" Under Section 133 Cr.P.C Police Station Kotwali Utraula District Balrampur expeditiously, if there is no legal impediment, while considering the guidelines and circulars issued in this regard.
