Judgment

Court No. - 18 Case :- MATTERS UNDER ARTICLE 227 No. - 5210 of 2023 Petitioner :- Guru Murat Respondent :- State Of U.P. Thru. Prin. Secy., Revenue, Lucknow And 8 Others Counsel for Petitioner :- Piyush Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Saurabh Lavania,J. Heard. In view of order proposed to be passed, issuance of notice to the private-respondents is hereby dispensed with. The present petition has been filed for the following main relief:- "i. Issue a order or direction thereby directing the opposite party no.2 to decide the Revision No.3080 of 2007-08 (Ayodhya Prasad & others versus Kripa Ram & another) filed by the opposite parties No.3 to 9 pending before him forthwith or within stipulated period as prescribed by this Hon'ble Court in the interest of justice. Annexure No.1)." It appears from the record that the revision was filed way back in the year 2008 and it was dismissed for want of prosecution on 03.01.2023 and thereafter the revisionist-petitioner preferred an application for recall of order dated 03.01.2023 and restoring the revision to its original number and this application was allowed vide order dated 10.05.2023 and now the revision is pending for final disposal. Considering the facts of the case as also that revision was filed in the year 2008 and as per para 458(2) of U.P. Revenue Court Manual, an appeal or revision should preferably be decided within a period of six months, this Court is of the view that justice would suffice, if a direction is issued to opposite party no.2/Board of Revenue, Lucknow, to decide the pending revision in issue, at the earliest. Accordingly the present petition is disposed of with direction to respondent no.2, to consider and decide the Revision No.3080 of 2007-08 (Ayodhya Prasad & others versus Kripa Ram & another) most expeditiously, after affording full opportunity of hearing to the parties, but without granting any unnecessary adjournment, preferably within a period of six months from the next date fixed before it, if there is no other legal impediment in this regard. It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 13.10.2023 Jyoti/- High Court of Judicature at Allahabad, Lucknow Bench
