¶1The present petition has been filed with the following prayer: "(i). To issue a writ, order or direction in the nature of mandamus commanding to opposite parties no.1 and 3 and directing them to remove the encroachment over the Chak Road Gata No.3096/0.026 hectare made by the opposite party no.4 situated at Village Sursanda, Pargana and Tahsil Naabganj, District Barabanki."

¶2Considering the nature of the prayer, the present petition is disposed off permitting the petitioner to approach the respondent no.3 by filing an appropriate application under Section 67 of the U.P. Revenue Code, who shall take further action in accordance with law.

¶3The petitioner would be at liberty to place whatever documents, he wants to file while moving the application under Section 67 of the U.P. Revenue Code. In case, such application is filed, the same shall be considered and decided expeditiously and in accordance with law preferably within a period of three months from the date of production of certified copy of this order.
