Petitioner has approached this Court with the following main prayers:- " i) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties nos. 2 to 5 to stop the opposite parties 6 to 9 not to establish/institute the Goddess Durga Statue on the land Gata No. 416 which is public way in revenue record situated at Village Semari, H/o Tedwa Mahant, Tehsil Kaiserganj, Police Station Fakharpur, District Bahraich in the festival of Navratri commencing from 15th October, 2023, in the interest of justice.

ii) Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties no. 2 to 5 to take appropriate legal action against the opposite parties no. 6 to 9 who are adamant to create communal riot in Village Semari, H/o Tedwa Mahant, Police Station Fakhapur, District Bahraich" Learned Standing Counsel on instructions received from S.D.M. concerned states that there is no obstruction in any manner on road and apprehension of petitioner is incorrect.
