¶1Heard learned counsel for the petitioner as well as learned AGA for the State and perused the record.

¶2Learned counsel for the petitioner after arguing at some length submits that he be permitted to withdraw the instant petition with the liberty to approach the appropriate Authority (Commissioner of the Division) under Section 6 of the U.P. Control of Goondas Act, 1970.

¶3No objection in this regard has been raised by learned AGA.

¶4Having regard to the request made by learned counsel for the petitioner, the instant petition is dismissed as withdrawn with the liberty aforesaid.

¶5Since the petitioner was litigating bonafidely, it is directed that with regard to the delay which would occur in preferring the appeal before the Commissioner, the appropriate Authority may take a lenient view, if the appeal is preferred within a reasonable time, to say within 15 days from today.
