¶1Heard Shri Sanjay Kumar Srivastava, learned counsel for the appellant, Shri Brijesh Kumar Singh, learned counsel for respondent No.2 and Shri V.P. Nag, learned Standing Counsel for State/respondent No.1.

¶2Learned counsel for the appellant prays that he may be permitted to withdraw this special appeal with liberty to institute the same afresh by enclosing all the documents along with the appeal. The defects which have been pointed out may also be rectified.

¶3Accordingly, the instant special appeal is dismissed as withdrawn with the aforesaid liberty.
