Judgment
Court No. - 3 Case :- WRIT - C No. - 8884 of 2023 Petitioner :- Koteshwar Respondent :- State Of U.P. Thru.Prin.Secy. Energy And Renewable Energy And 5 Others Counsel for Petitioner :- Vivek Kumar Tripathi,Sudhir Kumar Misra Counsel for Respondent :- C.S.C.,Aprajita Bansal Hon'ble Vivek Chaudhary,J. Hon'ble Manish Kumar,J. Petitioner has approached this Court challenging the provisional assessment notice issued to him. Petitioner has already submitted his objection to the aforesaid notice before Executive Engineer concerned and till date no demand notice has been issued against the petitioner. Learned counsel for the respondents states that final assessment order has yet not been passed hence, petition is premature. It goes without saying that any demand against the petitioner would only be raised after final order is passed by the Executive Engineer concerned in accordance with law, therefore petition is premature at this stage. At this stage, learned counsel for the petitioner states that petitioner's electricity connection has been disconnected yesterday by the respondents. Liberty is granted to the petitioner to file a fresh petition giving complete details of the case. Writ petition is disposed of.
