The instant Criminal Revision under Section 397/401 Cr.P.C. is directed against the order dated 18.08.2023 passed by learned Court of Additional Sessions Judge, Court No.4 / Special Judge, E.C. Act, Unnao in Criminal Revision No.86 of 2023, Complaint Case No.3279 of 2015, under Sections 323, 504, 506, 342 and 500 I.P.C. pending before the learned Chief Judicial Magistrate, Unnao. At the very outset, learned A.G.A.-I for the State has made a preliminary objection that the instant revision is not maintainable as the same is filed against the Criminal Revision, however, in the instant case, Application under Section 482 Cr.P.C. or Criminal Misc. Writ Petition may be filed. In view of above, learned counsel for the revisionists submits that she want to withdraw this revision with liberty to file afresh. Accordingly, the instant criminal revision is dismissed as withdrawn with liberty to file afresh. Office is directed to return all the certified copies of relevant documents to learned counsel for the revisionists after keeping photostat thereof on record.
