¶1Heard learned counsel for petitioner and learned Standing Counsel for State.

¶2Petitioner has approached this Court claiming that he has applied for permission to hold Durga Pooja by installing the idol of 'Maa Durga' in the ensuing Navratri and its immersion process thereafter, before the District Magistrate, Balrampur and his grievance would be sufÏciently met in case the representation dated 11.10.2023, is considered and decided expeditiously in a time bound manner.

¶3Sri Prabhakar Srivastava, Advocate has put in appearance on behalf of Siya Ram and claims that he is already holding Pooja on the property in dispute for the last many many years.

¶3Looking into the facts and circumstances and without entering into merits of the case, respondent no.4-District Magistrate, District -Balrampur is directed to consider the representation of petitioner and pass appropriate reasoned and speaking order on the same, in accordance with law, within a period of five days from the date a certified copy of this order is placed before him. The respondent No.4-District Magistrate, District Balrampur while considering the claim of the petitioner shall also hear Mr.Siya Ram who claims to be already holding Pooja on the spot for the last many many years and pass appropriate order.

¶4With the aforesaid, the writ petition is disposed of.
