¶1Present petition has been filed by the petitioner challenging the award dated 02.07.2013 whereby directions were issued for payment of Rs.1,32,900/- by a permanent lok adalat on account of damage sustained to the vehicle in an accident.
¶2Submission of learned counsel for the petitioner is that the said award was an ex-parte award and is based upon an assessment. The permanent lok adalat disbelieved the amount claimed by the applicant before it which was 1,47,950/-, however, based upon the repairs, an amount of Rs.1,32,900/- was awarded.
¶3Submission of learned counsel for the petitioner is that according to the report of Surveyor of the petitioner, the amount required for rectifying the damage sustained by the vehicle would be Rs.21,400/-.
¶4Considering the amount awarded being too small, I do not deem it appropriate to exercise the extraordinary jurisdiction under Article 226 of the Constitution of India. The writ petition is accordingly dismissed. Order Date :- 13.10.2023 nishant High Court of Judicature at Allahabad, Lucknow Bench
