Heard learned counsel for the applicant and learned AGA for the State and perused the record. The instant application has been filed with prayer to to modify the order dated 03/10/2023 and quash the payment submitting of 20% of entire fine imposed vide order dated 03/10/2023 passed in Criminal Appeal No. 239/2023 "Rangnath Verma Vs State of U.P. and another" pending before the District and Session Judge Lucknow, pending in the court of Learned District and Session Judge Lucknow. Learned counsel for the applicant after some argument confined his prayer to the extent that the time granted by this Court to deposit 20% of the penalty amount within 10 days from the date of the order i.e. 03.10.2022, may be extended for a period of one month so that the applicant may arrange the said amount and make compliance of the said order and deposit the same before the court concerned. Ms. Rabia Farukh, learned AGA for the State has no objection to the aforesaid prayer and submittedthat in the interest of justice the applicant may be given further one month's time from today to deposit the said amount. Accordingly, in view of the arguments as advanced by learned cousnel for the partied and considering the prayer made by learned counsel for the applicant, this application is allowed of with the direction to the applicant that the applicant shall deposit 20% of the penalty amount as directed by the court below vide order dated 03.10.2023 within one month from today without fail. It is made clear in case the the said amount shall not be deposited as directed by this Court, the court below is at liberty to recover the same in accordance with law.
