¶1Heard learned counsel for petitioner and learned Standing Counsel for State.

¶2Petitioner has approached this Court challenging the order dated 30.08.2023 passed by District Magistrate, Gonda/Prescribed Authority under Section 27 of Panchayati Raj Act, 1947 read with Rules 256 thereof by which certain demand is raised against the petitioner for the alleged financial loss caused to the State exchequer.

¶3Learned Standing Counsel raises a preliminary objection that petitioner has a statutory alternative remedy of appeal under Section 27(3) of Panchayati Raj Act, 1947 read with Rules of

258.

¶4With liberty to petitioner to file an appeal, present writ petition is consigned to record.

¶5Petitioner, in case he so desires, may file a stay application in the appeal which shall be considered and decided expeditiously by the appellate authority in accordance with law.
