¶1Heard learned counsel for the petitioner and learned counsel appearing for the U.P. State Road Transport Corporation.

¶2Considering the entire facts and circumstances of the case, the writ petition is finally disposed of with the direction to the Managing Director, U.P. State Road Transport Corporation, Lucknow to consider the case of the petitioner for payment of pension, keeping in view the judgement rendered by the Division Bench of this Court in Special Appeal No.813 of 2010 and also keeping in view the provisions contained in Regulation 39 of U.P. State Road Transport Corporation Employees (other than officers) Service Regulations, 1981. The aforesaid consideration by the Managing Director shall be made within a period of three months from the date of production of certified copy of this order.
