Heard learned counsel for the petitioners and learned A.G.A. for the State. Supplementary affidavit has been filed saying that although attempt has been made, the petitioners could not get hold of the injury report of the victim. Learned A.G.A. has produced before this Court the instructions and also copy of the case diary. Instructions sent by Sub-Inspector, Police Station Safipur, Unnao, are kept on record. Mohammad Arif was medically examined at Community Health Centre, Saffipur, Unnao, on 06.09.2023. The Medical Officer has mentioned two injuries caused by a hard and blunt object and both the injuries are simple in nature. In the medical examination report of Wasim Ahmed, four injuries have been found to have been caused by a hard and blunt object. He has been advised to be kept under observation and the matter has been referred to the District Hospital for expert opinion regarding the nature of injuries. Insofar as Atiq is concerned, there were two injuries, caused by a hard and blunt object and he was directed to be admitted to District Hospital for expert opinion and to be kept under observation. This Court, having perused the first information report and also the copy of the case diary, finds that a cognizable offence is made out. Accordingly, the writ petition is dismissed.
