Judgment
Court No. - 8 Case :- WRIT - A No. - 8064 of 2023 Petitioner :- Mahabir Prasad Gupta Respondent :- U.P. State Sugar Corporation Ltd. Thru. Managing Director And 2 Others Counsel for Petitioner :- Prabhat Kumar Upadhyay,Vidya Kant Mishra Counsel for Respondent :- Sanjeev Singh Hon'ble Pankaj Bhatia,J. Heard learned counsel for the parties and perused the material brought on record. The present writ petition has been filed by the petitioner alleging that the petitioner was an employee of U.P. State Sugar Corporation Limited, which ultimately came to be sold through a deed dated 18.07.2010 in favour of the respondent no. 2. In terms of the said deed, there was provision contained in paragraph 6.2 with regard to the service conditions of the employees. It is argued by the counsel for the petitioner that the petitioner retired from the respondent no. 2 in the year 2017, however, the benefits to which the petitioner is entitled were not extended to the petitioner, as such, the petitioner approached the respondent no. 1, who in turn, issued a letter dated 30.05.2022 requesting the respondent no. 2 to take a decision in respect of the petitioner. He further argued that despite the request made, the respondent no. 2 has not taken any decision so far and thus the present writ petition. Considering the submission made at the Bar, the fact remains that the petitioner seeks a mandamus against the respondent no. 2 for taking further steps in terms of the letter dated 30.05.2022. The respondent no. 2 being a private company, no writ can be issued as prayed. The writ petition lacks merit and is accordingly dismissed with the liberty of the petitioner to avail such remedy as may be available to him under law.
