In compliance of order of this Court dated 9.10.2023, the Executive Engineer concerned is present in person. In furtherance of order of this court, the order dated 13.10.2023 has been passed by the Executive Engineer concerned, whereby the objection of the petitioner against the final assessment of Rs. 3,62,1113.00/- has been decided. The order also notes that the said amount is also deposited by the petitioner. Learned counsel for the respondents states that the petitioner has statutory alternative remedy to file an appeal against the said order. It goes without saying that since the entire amount has been deposited by the petitioner, no further deposit is required to be made by the petitioner. With the aforesaid, the writ petition is disposed of. (Order on Application) This is an application for taking on record the compliance affidavit and appology. There is no objection on behalf of petitioners. The ground shown in the affidavit filed alongwith the application is sufficient.
