¶1Heard Sri Suresh Sharma, learned counsel for the petitioner as well as learned Standing counsel on behalf of respondent No.s 1, 2 and 3.

¶2By means of the present writ petition the petitioner has challenged the validity of the show cause notice dated

17.7.2023 issued by Sub Divisional Magistrate, Laharpur, District Sitapur.

¶3It is submitted on behalf of the petitioner that the petitioner is a fair price shop licensee of Village -Talvipur, Block and Tehsil - Laharpur, District Sitapur. License of another fair price shop dealer, namely Ram Lakhan of Village Karsyora, Block and Tehsil Laharpur, District Sitapur was suspended and subsequently cancelled and attached to the shop of the petitioner. The dispute is with regard to return of the goods issued for distribution to the card holders attached to the shop of Ram Lakhan due to which the show cause notice dated

17.7.2023 was issued.

¶4It has been submitted by learned counsel for the petitioner that the petitioner has already responded to the said show cause notice and submitted his reply on 28.7.2023 but no decision has been taken till date and consequently prays that respondent No.3 may be directed to decide the matter, expeditiously.

¶5Learned Standing counsel does not object to the prayer made by the petitioner.

¶6In view of the above, without entering into the merits of the case, the writ petition is disposed of with a direction to respondent No.3-Sub Divisional Officer, Tehsil - Laharpur, District Sitapur to decide the matter initiated by issuance of the show cause notice dated 17.7.2023 to which the petitioner has already responded on 28.7.2023, expeditiously, say within a period of one month from the date a certified copy of this order is placed before him in accordance with law and communicate the decision to the petitioner.
