¶1Heard Sri Ankur Srivastav, learned counsel for the petitioner.

¶2Learned counsel for the petitioner submits that the present petition has been filed for direction of disposal of Original Case no.84/2019 (Riyaz Khan vs Siraz and others) under Order 39 Rule 1 and 2 of C.P.C within time fixed by this Court whereas admittedly the petitioner has filed regular suit for permanent injunction with application under Order 39 Rule 1 and 2 CPC.

¶3In view of the above and the ambiguous prayer made in this petition, no direction can be issued by this Court. Even otherwise, the petitioner has not annexed the order sheet from

14.08.2023 onwards.

¶4As prayed, at this stage, by the learned counsel for the petitioner, the petition is dismissed as not pressed with liberty to file fresh with proper prayer and annexing the complete order sheet.
