¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.
¶2Petition has been filed seeking a direction to opposite parties for providing family pension to petitioner.
¶3It has been submitted that petitioner's father late Mohd. Suleman passed away on 12.11.2013 and during his lifetime, petitioner was granted a divorce on 14.04.2002. It is submitted that after expiry of petitioner's father, her mother was being provided family pension but she also expired on 15.05.2017. It is submitted that petitioner being dependent divorced daughter is covered under the relevant rules for providing family pension.
¶4It is submitted that petitioner's sister Shahin Bano had also filed Writ Petition No. 7244 (S/S) of 2019 which was disposed of vide order dated 14.03.2019 but her claim was rejected on
11.11.2019 on the ground of being over aged.
¶5With regard to aforesaid grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned. At present, learned counsel for petitioner restricts prayer for a decision with regard to same.
¶6Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no. 3 i.e. Executive Engineer, Nahar Sharda Sahayak, Sitapur who shall consider and decide the same within a period of eight weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
