And Another Counsel for Petitioner :- Durgesh Kumar Singh Counsel for Respondent :- Ankit Srivastava Hon'ble Vivek Chaudhary,J. Hon'ble Manish Kumar,J. Heard learned counsel for the parties and perused the record. Petitioner has approached this Court claiming that despite being nominee of Late Ram Kishor (her husband), after death of her husband the amount in question is not being released in her favour. Learned counsel for the respondent -Bank states that an application is filed by a 3rd party claiming a daughter of Late Ram Kishor and further claiming that the petitioner is second wife. Be that as it may, this fact is not disputed by the respondent-Bank that the petitioner is a nominee. It is also accepted by the respondent - Bank that there is no stay order of any Court with regard to the release of amount, therefore, the Bank is bound to release the money in favour of nominee, unless there is any legal impediment. Thus, the Respondent No.2 Branch Manager, State Bank of India, Branch - Safdarganj, District - Barabanki is directed to proceed and pass appropriate order and take action within a period of ten days from today for releasing the money unless there is any legal impediment on the basis of nomination.
