¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.
¶2Petition has been filed for following main relief:- "A writ, order or direction in the nature of Mandamus thereby commanding and directing the opp. party no.2 to take a decision with regard to providing the Pay Scale of Rs.5500-9000 to the petitioner with effect from the date from which the persons junior to the petitioner namely Pancham Ram and others have been granted the same in pursuance of the Government Order dated 21.06.2007 as contained in Annexure No.3 to this Writ Petition and subsequently revise the pay and pension accordingly for that the petitioner has represented his matter on through Representation dated 25.08.2022 as contained in Annexure No.7 to this Writ Petition."
¶3For the said grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned. At present, learned counsel for petitioner restricts prayer with regard to final decision on the same.
¶4Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no.2 i.e. Engineer-in-Chief (Establishment), Anubhag-4, Irrigation and Water Resources Department U.P., Lucknow who shall consider and decide the same within a period of eight weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
