Judgment

Court No. - 7 Case :- WRIT - A No. - 7928 of 2023 Petitioner :- Vipin Kumar Yadav And Others Respondent :- State Of U.P. Thru. Prin. Secy. Medical And Health Deptt. Lucknow And 3 Others Counsel for Petitioner :- Sandeep Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Abdul Moin,J.

1.Vakalatnama filed by Sri Tusar Mittar, learned counsel, on behalf of respondents no.3 and 4, is taken on record.

¶2Heard learned counsel for the petitioners, learned Standing Counsel for respondents no.1 and 2 and Sri Tusar Mittal, learned counsel for respondents no.3 and 4..

¶3Admittedly the petitioners are the employees of the service provider who are aggrieved by the termination orders dated

27.07.2021, 02.08.2021, 18.09.2021, 30.09.2021 and

11.04.2022.

¶4The contention of learned counsel for the petitioners is that after the petitioners had been appointed by the service provider their services were utilized by the service provider for the purpose of ambulance services to the general public. It is contended that the services of the petitioners were terminated subsequently by the service provider.

¶5Considering that as the service provider would not fall within the ambit of Article 12 of the Constitution of India as such it would not be possible for this Court to issue any writ to the service provider.

¶6With the aforesaid observation, the writ petition is disposed of leaving it open to the petitioners to pursue other remedy as may be available to them under law. Order Date :- 18.10.2023 A. Katiyar High Court of Judicature at Allahabad, Lucknow Bench
