In view of order proposed to be passed, issuance of notice to the private-respondent(s) is hereby dispensed with. The present petition has been filed for the following main reliefs:- "(i) issue a direction to the opposite party No. 2, i.e. Sub-Divisional Officer, Tanda, Ambedkar Nagar to decide the Case No. T2022204040303718 "Hari Shyam Versus Radhey Shyam & others", under section 144 of U.P. Revenue Code 2006, pending in the court of Sub-Divisional Officer, Tanda, District-Ambedkar Nagar expeditiously within stipulated period as early as possible, pending since 29.8.2022. Taking note of the facts that the case was instituted in August 2022 and the same has not been disposed of till date as also para 458(1) of U.P. Revenue Court Manual, which says that suit of such nature should be decided, within a period of one year, the present petition is disposed of with direction to respondent no.2/Sub-Divisional Officer, Tanda, Ambedkar Nagar, to decide the suit in issue taking note of para 458(1) of U.P. Revenue Court Manual, most expeditiously after affording full opportunity of hearing to the parties to the litigation. It is made clear that the Court has not examined the case of either party on merits and the Authority concerned shall be free to decide the matter strictly in accordance with law.
