¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.
¶2Petition has been filed seeking a direction to opposite parties to open the sealed cover envelope pertaining to petitioner's recommendation made by Departmental Promotion Committee and to promote him on post of Senior Assistant with effect from the date persons junior to him have been promoted.
¶3It has been submitted that earlier, petitioner was considered for such promotion but recommendations were kept in a sealed cover due to pendency of departmental proceedings which have culminated in passing of order dated 17.10.2022 in which petitioner has been exonerated and therefore the sealed envelope pertaining to petitioner's recommendation is to be opened with consequential benefits.
¶4For the said grievance, petitioner has already submitted a representation dated 23.09.2023 before the authority concerned. At present, learned counsel for petitioner restricts prayer with regard to final decision on the same.
¶5Considering the innocuous prayer, without entering into merits, opposite party no.2 i.e. Director(Administration), Medical and Health Services U.P., Lucknow is directed to consider and decide representation of petitioner dated
23.09.2023 expeditiously within a period of six weeks from the date a copy of this order is produced before authority concerned along with a copy of said representation.
¶6With aforesaid observations and directions, the petition is finally disposed of. Order Date :- 18.10.2023 kvg/- High Court of Judicature at Allahabad, Lucknow Bench
