Order on C.M.Application No. 05 of 2023 Learned counsel appearing for the applicant is pressing the application dated 16-10-2023 and submits that there were certain discrepancies in the application under section 482 Cr.P.C. bearing no. 5367 of 2023 because of the fact that certain documents could not been annexed and the pleadings with respect to the same could not be taken on record and therefore, he may be permitted to withdraw the application under section 482 Cr.P.C. bearing no. 5367 of 2023 with liberty to file a fresh application. Learned A.G.A. appearing for the State has no objection to the contentions aforesaid. In view of aforesaid submissions, the instant application is allowed and the application under section 482 Cr.P.C. bearing no. 5367 of 2023 is dismissed as not pressed with liberty to file a fresh. OfÏce is directed to return the certified copies of the orders, if any, to the learned counsel for the applicant forthwith.
