Court No. - 4 Case :- CONTEMPT APPLICATION (CIVIL) No. - 2024 of 2017 Applicant :- Ram Lakhan Yadav Opposite Party :- Prabhu Narayan Singh Vice Chairman. Lko. Development Autor Counsel for Applicant :- Ram Kumar Srivastava,Anil Kumar Akela Counsel for Opposite Party :- Rajnish Kumar Singh Hon'ble Rajesh Singh Chauhan,J.
¶1Heard learned counsel for the petitioner and Sri Ratnesh Chandra, learned counsel for the Lucknow Development Authority.
¶2Sri Ratnesh Chandra has drawn attention of this Court towards the short counter affidavit filed on 30.10.2018, wherein it has been categorically indicated in Para 5 that on 03.03.2017, the final costing letter was given to the petitioner indicating therein that total amount i.e. Rs. 7,08,582/- which was to be paid to the petitioner but the petitioner has not deposited that amount.
¶3Learned counsel for the petitioner has stated that while calculating the final costing letter, the LDA has calculated the interest w.e.f. 14.10.2015, from the date of judgment till
03.03.2017, from the date of issuance of costing letter). This is patently illegal and unwarranted for that petitioner has represented before LDA for doing the needful exercise but of no avail.
¶4Be that as it may, when the LDA had issued final costing letter on 03.03.2017, the petitioner had got only two option either to deposit the aforesaid amount in terms of the order of Writ Court dated 14.10.2015 or to assail the aforesaid costing letter before the appropriate Court of law but both the aforesaid things have not been done by the petitioner, therefore, nothing remains to be adjudicated in the present contempt petition.
¶5Accordingly, the instant contempt petition is dismissed.
¶6Notices are discharged.
¶7However, it is always open for the petitioner to raise his grievance, if any, before the appropriate Court of law/authority strictly in accordance with law. [Rajesh Singh Chauhan,J.] Order Date :- 18.10.2023 kkv/ High Court of Judicature at Allahabad, Lucknow Bench
