¶1Learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed challenging order dated 30.09.2023 whereby petitioner has been transferred from Development Block Gaur in District Basti to the Development Block Rudauli in the same District.

¶3Although, learned counsel has drawn attention to paragraph 3

(iii) of the Government Order dated 07.06.2023 to the effect that impugned order has been passed without taking approval or sanction from the authority concerned but at present restricts his prayer for a decision on petitioner's representation dated

03.10.2023.

¶4Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to supply a certified copy of this order to the authority concerned along with a copy of representation dated 03.10.2023 within a period of three days from today. In case the aforesaid time frame is adhered to, the opposite party no. 2 i.e. Commissioner, Rural Development, Uttar Pradesh Jawahar Bhawan, Lucknow is directed to decide the same within a period of ten days thereafter.

¶5Till the decision on petitioner's representation, petitioner shall not be compelled to join at the transfered place.
