In view of order proposed to be passed, issuance of notice to the private-respondent(s) is hereby dispensed with. The present petition has been filed for the following main relief:- "(I) to issue an order or direction opposite parties especially opposite party No. 2 to decide the Case No. T20140830073768, 'Prabhagiya Vanadhikari, Gonda Vs. Rajeev Ranjan & Others', under section 229 B of U.P.Z.A. & L.R. Act, 1950, pending in the court of opposite party No. 2 expeditiously within stipulated period in the interest of justice." Taking note of the facts of the case as also that the case in issue i.e. Case No. T20140830073768, (Prabhagiya Vanadhikari, Gonda Vs. Rajeev Ranjan & Others) is pending since 2019, this petition is disposed of with direction to opposite party no.2/Sub Divisional Magistrate (Judicial), Mankapur, Gonda to consider and decide the pending Case in issue, detailed above, most expeditiously, after affording full opportunity of hearing to the parties, but without granting any unnecessary adjournment, preferably within a period of one year from the next date fixed before it, if there is no other legal impediment in this regard. It is made clear that the Court has not examined the case of either party on merits and the Authority concerned shall be free to decide the matter strictly in accordance with law.
