Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5405 of 2023 Petitioner :- Vimala Devi Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. U.P. Lko. And 3 Others Counsel for Petitioner :- Amit Pandey Counsel for Respondent :- C.S.C. Hon'ble Rajnish Kumar,J. Heard Sri Amit Pandey learned counsel for the petitioner and learned Standing counsel. Submission of learned counsel for the petitioner is that the petitioner has filed a Regular Suit no.1702 of 2021 for cancellation of sale deed and permanent injunction alongwith an application for interim injunction, on which, notices were issued on 03.09.2021 but till date the same has not been disposed of. Perusal of the order sheet indicates that the petitioner does not appear to press his application for interim injunction. However, the same has been filed alongwith regular suit and the same is required to be disposed of. Learned counsel for the petitioner after arguing at some length, restricted his prayer for a direction for disposal of application for interim injunction i.e prayer no.1, at this stage. To which, there is no objection by the other side. Without entering into merits of the case, the petition is disposed of with liberty to the petitioner to move an application before the court concerned within a period of ten days from today for disposal of application for interim injunction. In case, such an application is moved, the same shall be considered by the concerned court preferably on the date fixed, which is said to be

29.11.2023 or within a further period of two weeks thereafter and pass appropriate order thereon and endeavour to decide the application expeditiously in accordance with law without granting any unnecessary adjournment to either of the parties, if there is no impediment.
