¶1Heard counsel for the parties.

¶2Learned A.G.A. raised preliminary objection and submitted that in pursuance of order dated 15.12.2022, in Criminal Misc. Application No.565 of 2021 under Section 125 Cr.P.C. impugned non-bailable warrant has been issued but the main order has not been challenged, anywhere, therefore, application is liable to be dismissed.

¶3After arguing at some length, learned counsel for the applicant submits that he does not want to press the present application and prays for withdrawal of the same with liberty to file afresh.

¶4His prayer is accorded.

¶5Accordingly, the application is dismissed as withdrawn with the aforesaid liberty.
