Judgment
Court No. - 17 Case :- TRANSFER APPLICATION (CIVIL) No. - 221 of 2023 Applicant :- Ravindra Kumar Opposite Party :- District Magistrate/Collector Sultanpur And Ors. Counsel for Applicant :- Hari Shanker Tewari Counsel for Opposite Party :- C.S.C. Hon'ble Alok Mathur,J.
¶1Heard Sri Hari Shanker Tewari, learned counsel for the applicant as well as learned Standing Counsel for the respondents.
¶2By means of present writ petition the petitioner has sought transfer of Case No. D202304680003256 - Ravindra Kumar Vs. Hem Lata and Others, pending before Sub Registrar, Lambhua, Sultanpur to any other Sub Registrar of District Sultanpur preferably to Sub Registrar, Sadar, Sultanpur.
¶3Learned Standing Counsel at the very outset has raised preliminary objection stating that an application under Section 24 C.P.C. would not be maintainable as transfer of case from one Sub Registrar to another Sub Registrar of same district is not permissible as Sub Registrar does not functions as a Court.
¶4Learned counsel for the petitioner after arguing the matter up to some length, prays that he may be permitted to withdraw the present application with liberty to approach appropriate forum for redressal of his grievance.
¶5In the light of above, present transfer application is dismissed as withdrawn with liberty to the petitioner to approach competent authority/forum for redressal of his grievance.
¶6In case petitioner approaches the competent authority/forum, his grievance shall be considered and decided expeditiously. Order Date :- 19.10.2023/A. Verma (Alok Mathur, J.) High Court of Judicature at Allahabad, Lucknow Bench
