This petition has been filed with the following main prayer:- "Issue a writ, order or direction in the nature of certiorari for quashing the impugned First Information Report dated 07.10.2023 registered as Case Crime No.0588/2023, under Sections 409 & 420 I.P.C., Police Station-P.S. Gomti Nagar, District Lucknow East (Commissionerate Lucknow) as contained in Annexure no.1 to this writ petition." Learned counsel for the petitioner says that the petitioner has no role to play and he has been falsely implicated in the impugned F.I.R. This Court has gone through the contents of the F.I.R. and finds that it relates to a Ponzi Scheme run by the Shine City Erector, wherein they promised the gullible investors to deposit their money and in return they would get plots allotted in their favour and, in case, the plots are not allotted to them, then they would get their money back along with double interest thereon. After having examined the submissions advanced by learned counsel for the parties and perused the impugned F.I.R., we are of the opinion that the impugned F.I.R. discloses cognizable offence by the petitioner, hence, no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the F.I.R. or for grant of any interim relief to the petitioner and accordingly, the present writ petition is dismissed.
